For All Users (Before Registering on SpotLet)

For the purposes of this agreement:

• “SpotLet” refers to SpotLet Private Limited, the owner and operator of the platform.
• “Website” or “Platform” refers to the official website https://spotlet.co and any affiliated subdomains or mobile applications operated by SpotLet.
• "User” refers to any individual or entity accessing the SpotLet platform, whether or not they are registered.
• “Registered User” refers to a person who has signed up with SpotLet to explore, inquire, or interact with listings.
• “Host” refers to a property owner or authorized individual who lists a property on SpotLet.
• “Property” means any real estate asset listed on SpotLet including but not limited to villas, apartments, farms, event venues, or studios.
• “Guest” refers to a user intending to rent or inquire about a listed property.
• “Listing” means the digital property page created by the host on the SpotLet platform.
• “Lead” refers to an inquiry or potential guest contact generated through SpotLet.
• “Plan” refers to the chosen SpotLet subscription plan selected by a host.
• “Content” includes any media, descriptions, text, or material shared on the platform by users or SpotLet.

Access to and use of the SpotLet platform is subject to the following eligibility criteria. By using the platform, you confirm that:

• a) Minimum Age Requirement

  You are at least 18 years of age or the age of majority as defined by your jurisdiction, whichever is higher. SpotLet does not knowingly collect or allow use of its services by minors. If you are under 18, you may not access or use the platform under any circumstances.

  b) Legal Capacity

  You have the full legal capacity and authority to enter into this agreement. If you are using SpotLet on behalf of a company, organization, or legal entity, you represent and warrant that you are authorized to bind such entity to these Terms & Conditions.

  c) Compliance with Laws

  You are not prohibited by any applicable law, court order, or administrative ruling from using the SpotLet platform. You agree to comply with all applicable local, state, national, and international laws, regulations, and ordinances.

  d) Use for Legitimate Purposes Only

  You agree to use the platform only for purposes that are lawful and intended under the nature of SpotLet’s services, such as browsing, inquiring, listing, or managing property bookings.

  e) Account Integrity

  SpotLet reserves the right to deny access, suspend services, or terminate accounts for users who provide false information, impersonate others, misuse the platform, or violate any part of these Terms & Conditions.

You may:

• Browse property listings for informational purposes.
• View, compare, and inquire about properties.
• Access publicly available content and features offered by SpotLet.
• Share links to SpotLet listings or pages for non-commercial purposes.

You may not:

• Copy, reproduce, distribute, mirror, frame, or modify any part of the SpotLet platform without express written consent.
• Use the website for any fraudulent, harmful, or unlawful purpose.
• Extract data manually or using automated tools (e.g., scraping, bots, spiders).
• Interfere with or disrupt the functioning of the platform, servers, or connected networks.
• Upload or share any content that is false, misleading, defamatory, obscene, or otherwise violates applicable laws or the rights of others.
• Attempt to reverse-engineer, decompile, or disassemble any part of the platform or its underlying technology.

Unless otherwise stated, SpotLet owns all rights, title, and interest in:

• Website content, including text, graphics, logos, icons, audio, video, and images.
• Platform architecture, source code, interface design, and backend technology.
• SpotLet name, logo, slogans, service marks, and trade dress.
• Databases and aggregated data derived from user activity (excluding personal data).

If you submit or upload any content (such as inquiries, reviews, comments, or media) while browsing or interacting with SpotLet:

• You retain ownership of your content.
• You grant SpotLet a worldwide, royalty-free, non-exclusive license to use, display, reproduce, adapt, and distribute such content on the platform and in promotional materials, in accordance with our Privacy Policy.
• You represent and warrant that you have the legal right to share such content and that it does not infringe the intellectual property rights of any third party.

As a user of SpotLet (without registering), you are allowed to:

• Browse and search for properties based on category, location, or date.
• View publicly available property listings and related media.
• SpotLet name, logo, slogans, service marks, and trade dress.
• Submit inquiries through listing pages or contact forms.
• Read and engage with SpotLet informational content, such as blogs, FAQs, or policies.

You agree not to engage in any of the following:

Platform Misuse

• Use bots, crawlers, scripts, or any automated methods to extract data.
• Attempt to gain unauthorized access to user accounts, SpotLet servers, or restricted areas of the platform.
• Interfere with or disrupt the integrity, performance, or security of the platform.

Deceptive or Harmful Behavior

• Submit false or misleading inquiries or impersonate others.
• Falsely represent a property or submit contact details with malicious intent.
• Upload or distribute content that is defamatory, obscene, hateful, abusive, harassing, or violates the rights of others.

Violation of Legal or Platform Rules

• Use SpotLet in violation of any local, state, national, or international law or regulation.
• Attempt to collect personal data from users without their knowledge or consent.
• Circumvent any technical limitations or content restrictions on the platform.

Commercial Exploitation

• Reuse, reproduce, or redistribute listings, images, or videos from SpotLet for commercial gain.
• Promote unrelated third-party products, services, or websites through links or messaging.

Violation of these terms may result in temporary suspension or permanent banning from the SpotLet platform, including legal action where necessary.

SpotLet shall not be liable for any loss, damage, or liability arising from your use of Third-Party Services, including but not limited to:

• Transaction failures or errors.
• Data breaches or misuse of personal information.
• Service interruptions or discontinuations.
• Fraudulent or unlawful acts committed by third parties.

When you use Third-Party Services through SpotLet:

• You agree to comply with the applicable terms and policies of those services.
• You acknowledge the risks involved and assume full responsibility for your interactions.
• You agree that SpotLet has no liability or obligation arising from such third-party interactions.

SpotLet is provided on an “AS IS” and “AS AVAILABLE” basis without any warranties, express or implied. To the fullest extent permitted by law, SpotLet disclaims all warranties, including but not limited to:

• Merchantability,
• Fitness for a particular purpose,
• Non-infringement,
• Accuracy, completeness, or reliability of any information or content,
• Availability or uninterrupted access,
• Security or privacy of data transmitted through the platform.

In no event shall SpotLet, its affiliates, directors, employees, agents, or partners be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:

• Loss of profits,
• Loss of data,
• Business interruption,
• Loss of goodwill,
• Personal injury or property damage,
• Any other damages arising out of or related to your use or inability to use the SpotLet platform.

SpotLet shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to:

• Natural disasters,
• Acts of government or regulatory authorities,
• Cyber-attacks,
• Internet or telecommunications failures,
• Strikes or labor disputes,
• Other unforeseeable events.

You agree to indemnify, defend, and hold harmless SpotLet, its affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the "Indemnified Parties") from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to:

• Your use of, or conduct on, the SpotLet platform;
• Your violation of these Terms & Conditions or any applicable laws, regulations, or third-party rights;
• Any content you submit, post, or transmit via SpotLet;
• Your infringement or alleged infringement of any intellectual property or other rights of any person or entity;
• Your breach of any representation, warranty, or obligation under these Terms;
• Any negligent or wrongful acts or omissions by you in connection with your use of SpotLet.

When significant changes are made to the Terms & Conditions, SpotLet will make reasonable efforts to notify users by:

• Posting a notice on the SpotLet website or app,
• Sending an email notification to registered users (where applicable),
• Displaying an alert upon login or access to the platform.
